Terms and Conditions
These Terms and Conditions apply to your use of the 865 Titan Concrete website, requests for bids or estimates, project communication, quotes, invoices, and concrete work performed by 865 Titan Concrete LLC ("865 Titan Concrete," "we," "us," or "our"). By using our website, submitting a form, requesting a bid, approving a quote, paying an invoice, using a client portal, or communicating with us by email, phone, or text message, you agree to these terms.
These general terms supplement the written quote, proposal, invoice, or signed agreement for a specific project. If a written project agreement signed by both parties conflicts with these terms, the signed project agreement controls for that project.
Services
865 Titan Concrete is a concrete contractor serving Knoxville and surrounding East Tennessee. We review, quote, schedule, and perform commercial and residential concrete work, including foundations, slabs, flatwork, site concrete, sidewalks, retaining walls, driveways, patios, pool decks, decorative concrete, sport court pads, and related work when accepted in writing.
Quotes, Bids, And Written Scope
Quotes and bids are based on the information available at the time they are prepared, including plans, specifications, photos, measurements, site information, and customer-provided details. Pricing is only valid for the period stated in the quote. If no period is stated, pricing is valid for 30 days.
The written scope controls what is included. Work not specifically listed in the written scope is excluded unless added by written change order. Common exclusions may include permits, engineering, surveying, staking, testing, inspections, demolition, haul-off, unsuitable subgrade correction, rock excavation, utility relocation, traffic control, bonds, premium-time work, special insurance requirements, and work required by revised plans or field conditions unless expressly included in writing.
Acceptance, Changes, And Change Orders
A quote may be accepted by signature, written approval by email or text, payment of a required deposit, or allowing scheduled work to begin. Changes to scope, quantities, materials, finishes, access, schedule, or site conditions may affect price and timing. Change orders must be approved in writing before additional work is performed, except for urgent safety or site-protection work that cannot reasonably wait.
Customer Responsibilities
The customer is responsible for providing accurate project information, site access, approved plans and specifications, property lines, private utility locations, owner or general contractor approvals, and any permits or inspections unless the written scope says otherwise. The customer must identify underground utilities, irrigation, septic, drainage, electrical, gas, communications lines, and other site conditions not visible at the surface.
Schedule, Weather, And Site Conditions
Schedules are estimates and may change due to weather, site readiness, material availability, crew availability, inspections, other trades, changes in scope, safety issues, or conditions outside our control. Concrete work is especially weather-sensitive. We are not responsible for delays caused by unsuitable site conditions, late approvals, blocked access, utility conflicts, other contractors, or events outside our reasonable control.
Payment, Invoices, And Collections
Deposits, progress payments, retainage, and final payment terms are stated in the written quote, invoice, or project agreement. Payment is due according to those written terms. Past-due balances may result in paused work, delayed scheduling, late charges where allowed by law, and recovery of reasonable collection costs, attorney fees, or filing costs where permitted by the project agreement and applicable law.
Concrete Expectations And Warranty Limits
Concrete is a site-built product affected by weather, soil, drainage, curing, load, maintenance, and use. Minor cracking, color variation, texture variation, surface wear, curing marks, and saw-cut or control-joint performance can occur and are not automatically defects. Unless a written warranty states otherwise, 865 Titan Concrete does not warrant damage or movement caused by soil settlement, poor drainage, freeze-thaw conditions, deicing chemicals, heavy loads, abuse, third-party work, owner maintenance issues, existing structures, trees or roots, or conditions outside our control.
Commercial Project Coordination
For commercial, general contractor, developer, builder, or property manager projects, the customer is responsible for providing the latest approved plans, specifications, addenda, schedule requirements, insurance requirements, billing requirements, site rules, and contact information before work is scheduled. Additional requirements not disclosed before pricing may require a revised quote or change order.
Photos, Documentation, And Project Records
We may photograph or document work areas before, during, and after a project for estimating, quality control, scheduling, warranty review, records, and marketing. We avoid intentionally publishing private personal information. If a project has confidentiality requirements, those requirements must be provided and accepted in writing before work begins.
SMS/Text Messaging Terms
By voluntarily providing your phone number and opting in through our website, a request or booking form, a quote or invoice process, a client portal, email, phone call, or another lawful opt-in method, you agree to receive recurring automated text messages from 865 Titan Concrete at the phone number provided. Messages may include customer inquiries, estimate follow-ups, appointment reminders, scheduling coordination, project updates, customer service messages, and occasional promotional messages where consent has been provided.

Nothing in these terms limits rights that cannot legally be limited.
Privacy
Your use of our website, forms, quotes, bookings, invoices, client portals, and communications with us are also governed by our Privacy Policy, including how we collect, use, store, and share customer information and SMS consent. We may use third-party service providers to operate these business systems, but those providers are not responsible for 865 Titan Concrete's services or communications.
Governing Law
These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Project-specific dispute terms may be stated in a written quote, proposal, contract, or signed agreement.
